1. Definitions
(a) “App”: the PayParq mobile application(s) and web interfaces.
(b) “Service”: parking booking, payment, enforcement, and analytics services offered via PayParq.
(c) “User”: any individual or legal entity using the Service, including Drivers, Operators, Municipal Partners, and Guests.
(d) “Driver”: a User parking a motor vehicle using the Service.
(e) “Operator”: a licensed entity or individual offering parking spaces through PayParq.
(f) “Municipal Partner”: a city or governmental body integrating PayParq for parking management.
(g) “Third‑Party Provider”: payment processors, communication platforms, mapping services, and enforcement partners.
(h) “Content”: all data, text, graphics, or information created or submitted by Users or PayParq.
2. Acceptance of Terms
By accessing or using PayParq in any form (app, website, or third-party integration), you agree to be bound by these Terms. If you do not accept them fully, you must immediately stop using the Service.
These Terms constitute a legally binding contract between you and Indirektno (PayParq).
3. Eligibility & Account Registration
3.1 Eligibility
The Service is for Users 18 years or older. By using the Service, you confirm:
- You have the legal capacity to enter a binding agreement;
- You will comply with all applicable EU, Croatian, and local laws;
- You will follow parking regulations and traffic rules in any jurisdiction you operate.
3.2 Account Registration
To access core features, Users must create an account:
- Provide accurate, complete, and current information;
- Maintain security of login credentials;
- Immediately notify PayParq of unauthorized use.
Note: PayParq is not responsible for account compromise or unauthorized use by third parties.
4. Description of Services
PayParq offers:
- Parking Authorization & Payment: Users can find, book, and pay for parking spaces.
- Enforcement Tools: Operators and Municipal Partners may monitor compliance.
- Data Analytics: Reporting dashboards for usage, revenue, and occupancy.
- Communication Tools: SMS, email, push notifications.
- Optional Insurance Products: Available via third-party providers.
Disclaimer: PayParq is a software platform only. Operational responsibilities, vehicle safety, and compliance are fully borne by Users.
5. Use of the Platform
5.1 License Grant
PayParq grants a limited, non-exclusive, non-transferable license to access and use the Service in compliance with these Terms.
5.2 Acceptable Use
Users may not:
- Violate EU, Croatian, or local laws;
- Upload malware, viruses, or harmful code;
- Reverse engineer the App or API;
- Attempt to access restricted areas;
- Misuse the platform or third-party integrations.
6. Fees, Payments & Billing
6.1 Payment Obligations
Users agree to pay applicable fees for parking, services, or optional insurance. Fees may vary by location or market conditions.
6.2 Third-Party Payment Processing
Payments are processed via integrated providers. PayParq is not responsible for processing errors or disputes beyond facilitating the transaction.
6.3 Billing Disputes
Disputes must be submitted within 30 days. PayParq may assist but does not guarantee refunds.
6.4 Taxes
Users are responsible for applicable EU VAT, local taxes, or duties.
7. Parking Rules, Conduct, and Enforcement
Users assume full responsibility for observing local parking laws.
Operators and Municipal Partners manage enforcement; PayParq is not liable for fines or legal actions.
PayParq does not guarantee space availability, pricing, or accuracy.
8. No Liability — Risk Allocation
8.1 Express Disclaimer
To the maximum extent allowed by EU and Croatian law, PayParq and affiliates are not liable for:
- Vehicle damage, theft, or vandalism;
- Personal injury or death;
- Fines, enforcement, or legal claims;
- Payment disputes;
- Data breaches, account compromise, or service outages;
- Third-party integrations (Stripe, WhatsApp, Uber, etc.).
8.2 No Warranties
Service is provided “as is” and “as available”, without any warranty of fitness, merchantability, or non-infringement.
8.3 Risk Allocation
Use is at your sole risk. PayParq is not an insurer and does not assume responsibility for parking safety or compliance.
9. Insurance and Optional Coverages
Any optional insurance is provided by third-party carriers. PayParq is not responsible for denied claims, limits, or carrier conduct.
10. Data Collection, Privacy, and Retention
10.1 Consent
Users consent to collection and processing of personal data in accordance with EU GDPR and PayParq Privacy Policy.
10.2 Retention
Data may be stored indefinitely for:
- Operational purposes
- Analytics
- Legal compliance
- Security
10.3 Security
PayParq applies industry-standard security measures but cannot guarantee absolute protection.
11. Intellectual Property
All software, graphics, logos, and content remain the property of PayParq or its licensors. Users may not copy, distribute, or modify content without permission.
12. Termination and Suspension
PayParq may suspend or terminate accounts for:
- Breach of Terms
- Fraud or unauthorized use
- Legal obligations
Termination does not release Users from liability or indemnification obligations.
13. Dispute Resolution; Arbitration
Disputes are governed by Croatian law, EU regulations, and may be resolved via:
- Arbitration under Croatian Chamber of Commerce rules
- Waiver of class actions or jury trial claims
14. Indemnification
Users agree to indemnify and hold PayParq harmless for claims arising from:
- Violation of Terms
- Parking violations or traffic offenses
- Misuse of the platform
15. Modification of Terms
PayParq may update Terms at any time. Continued use after updates constitutes acceptance.
16. Electronic Communications
Users consent to:
- Emails, push notifications, in-app messages for notices
- Electronic agreements being legally binding
17. Severability; Waiver
Invalid provisions do not invalidate the remainder of these Terms.
Waiver of a breach does not waive future breaches.
18. Assignment
Users may not assign rights. PayParq may assign rights to affiliates or successors.
19. Entire Agreement
These Terms and referenced policies are the full agreement between Users and PayParq.
20. Addendum A — Edge Cases and Absolute Disclaimers
The following scenarios are expressly disclaimed:
- Natural disasters (floods, earthquakes, storms)
- Acts of terrorism, war, civil unrest
- Vehicle malfunctions, mechanical failures
- Cybersecurity breaches, hacking, device loss
- Fines, penalties, or government enforcement
- Third-party service failures (Stripe, Uber, WhatsApp)
- Unauthorized device modifications
- Any indirect, incidental, or punitive damages
- Parking outside authorized zones
- Data loss from user or device error
All Users acknowledge these risks and accept full responsibility.

21. Marketplace Platform & Operating Partners
PayParq is a technology marketplace that connects drivers with parking locations and related services. PayParq does not itself physically operate the parking sites. On-site operations — including access control, staffing, security, shuttle transfers, and managed-lot operations — are provided by independent operating partners (lot owners, managed-lot operators and service providers) that contract with PayParq. In arranging a booking, PayParq acts as an intermediary and, where applicable, as agent for the operating partner.
Except where PayParq is the direct counterparty stated on your booking, the parking service itself is supplied by the operating partner responsible for the selected location. PayParq is not liable for the acts, omissions, condition of premises, or availability of any operating partner beyond PayParq's own role in facilitating the transaction, to the maximum extent permitted by applicable law. Nothing in these Terms limits mandatory consumer-protection rights that cannot be excluded under Croatian or EU law.
22. Parking Enforcement
Where a location uses PayParq for enforcement, PayParq issues parking charge notices for unpaid or overstayed parking and delivers them to the address registered to the vehicle. A parking charge notice is a contractual charge for use of the parking facility — PayParq is a private service provider and not a public authority, and such notices are not governmental fines or penalties.
By parking at an enforced location, you accept the posted terms of that location, including the applicable charge for unpaid or overstayed parking. Enforcement is carried out in compliance with the GDPR and applicable Croatian and EU law in every country where PayParq operates, using vehicle and keeper data obtained through lawful channels. You may query or appeal a notice through the contact channel printed on it.
23. PayParq Membership
Completing a purchase through PayParq makes you a PayParq member. A member account is created and maintained using your contact details so PayParq can deliver bookings, issue receipts and passes, provide support, and operate loyalty and returning-customer features. Membership is governed by these Terms and the Privacy Policy. Service communications form part of the membership; marketing communications are sent only with your consent and can be withdrawn at any time without affecting your bookings.
24. Draft Proposals & Business Development
PayParq engages prospective partners through a clear two-stage process:
- Stage 1 — Draft Proposal. PayParq may prepare a non-binding, conceptual proposal for a prospective location or business using publicly available information and publicly available images. Any images, names, marks or materials shown are used solely for identification and illustration, remain the property of their respective owners, imply no affiliation or endorsement, and are shown for evaluation and discussion only.
- Stage 2 — Deeper Integration & Partnership. Any integration, data sharing, listing, or partnership takes place only after the prospective partner confirms interest and a formal agreement is concluded — either a signed written agreement or an electronic agreement accepted by agreeing to these Terms.
A Draft Proposal does not create a partnership, agency, joint venture, listing, endorsement, or any binding obligation, and transfers no intellectual-property rights. Processing of a prospective partner's business information at Stage 1 is carried out on the basis of PayParq's legitimate interest in business development, limited to publicly available data, and is described in the Privacy Policy.
DISCLAIMER: This draft proposal, including all descriptions and estimated pricing, is a non-binding conceptual outline prepared for discussion and evaluation purposes only. It does not constitute a formal commercial offer, price commitment, or binding agreement. Final terms, pricing, and integrations are subject to formal mutual contract execution.
Removal on request. Any business featured in a Draft Proposal may request correction or removal of its data or images at any time by emailing payparq@outlook.com; PayParq will action such requests promptly.
Addendum — Proposed Parking Locations
Some locations displayed on PayParq may be proposed or unverified parking locations and are shown for informational, promotional, or demand-testing purposes only.
These locations are not available for online booking unless explicitly marked as bookable. Displayed prices, availability, photos, descriptions, and other information may be indicative and must be confirmed before parking.
Users may contact PayParq via WhatsApp or other available contact methods to request confirmation of availability and current pricing.
PayParq does not guarantee that a proposed location is available, legally authorized for parking, or available at the displayed price until the location has been verified and confirmed for booking.
25. On-Site Parking Terms — Croatia
The following are the on-site parking terms that apply at PayParq-managed car parks in Croatia, shown in Croatian (the authoritative on-site version).
PAYPARQ
OPĆI UVJETI KORIŠTENJA PARKIRALIŠTA
1. PRIHVAĆANJE UVJETA
1.1. Ulaskom i/ili parkiranjem vozila na parkiralištu Korisnik prihvaća ove Opće uvjete korištenja parkirališta (dalje: „Uvjeti“) i pravila istaknuta na parkiralištu.
1.2. Ovi Uvjeti uređuju prava i obveze Korisnika, društva PayParq odnosno ovlaštenog upravitelja parkirališta te drugih osoba uključenih u upravljanje parkiralištem.
1.3. Korištenjem parkirališta Korisnik potvrđuje da je upoznat s ovim Uvjetima te da ih prihvaća.
2. SKLAPANJE UGOVORA
2.1. Ugovor o korištenju parkirališta sklapa se između Korisnika i društva PayParq odnosno vlasnika ili ovlaštenog operatora parkirališta.
2.2. Ugovor nastaje ulaskom vozila na parkiralište, odnosno korištenjem parkirnog mjesta, osim ako je na pojedinom parkiralištu drugačije navedeno.
2.3. Korisnik je dužan poštivati sve prometne znakove, obavijesti, oznake na parkiralištu i ove Uvjete.
2.4. PayParq može upravljati parkiralištem, naplatom parkiranja, kontrolom korištenja parkirališta i postupkom naplate potraživanja, samostalno ili putem ovlaštenih partnera.
3. PRAVILA KORIŠTENJA PARKIRALIŠTA
3.1. Korisnik je dužan parkirati vozilo na označenom parkirnom mjestu i na način kojim se ne ometa promet ili korištenje drugih parkirnih mjesta.
3.2. Vozilo mora biti propisno parkirano i ne smije zauzimati više parkirnih mjesta osim ako je to izričito dopušteno.
3.3. Zabranjeno je parkiranje na mjestima rezerviranim za druga vozila, korisnike ili posebne namjene bez odgovarajućeg ovlaštenja.
3.4. Korisnik je dužan pridržavati se svih ograničenja i pravila koja su istaknuta na ulazu ili drugdje na parkiralištu.
4. VRIJEME TRAJANJA PARKIRANJA I NAKNADA ZA PARKIRANJE
4.1. Parkiranje se naplaćuje prema cjeniku istaknutom na parkiralištu ili prema cijeni prikazanoj prilikom rezervacije.
4.2. Korisnik je dužan platiti naknadu za parkiranje na način i u roku koji je naveden na parkiralištu.
4.3. Ako je određeno besplatno vrijeme parkiranja, ono vrijedi samo pod uvjetima navedenima na parkiralištu.
4.4. Nakon isteka dopuštenog vremena parkiranja Korisnik je dužan napustiti parkiralište ili izvršiti odgovarajuće produženje odnosno plaćanje parkiranja.
5. DNEVNA / UGOVORNA NAKNADA ZA NEOVLAŠTENO PARKIRANJE
5.1. Ako Korisnik ne plati parkiranje, prekorači dopušteno vrijeme ili na drugi način prekrši ove Uvjete, može mu biti obračunata naknada za neovlašteno korištenje parkirališta u iznosu istaknutom na parkiralištu.
5.2. Naknada se može naplatiti neovisno o eventualno neplaćenoj osnovnoj naknadi za parkiranje, kada je to primjenjivo.
5.3. U slučaju neplaćanja mogu nastati dodatni troškovi obrade, opomena i naplate, u mjeri dopuštenoj važećim propisima.
6. SIGURNOST PARKIRALIŠTA
6.1. Korisnik je dužan zaključati vozilo i poduzeti uobičajene mjere zaštite vozila.
6.2. Korisnik ne smije ostavljati vrijedne predmete na vidljivim mjestima u vozilu.
6.3. PayParq odnosno operator parkirališta ne odgovara za stvari ostavljene u vozilu, osim u slučajevima odgovornosti propisanim važećim zakonom.
7. NASTANAK ŠTETE NA VOZILU I IMOVINI
7.1. Korisnik je odgovoran za štetu koju svojim postupanjem prouzroči na parkiralištu, drugim vozilima ili drugoj imovini.
7.2. Korisnik je dužan odmah prijaviti PayParqu odnosno operatoru svaku štetu ili incident koji se dogodio na parkiralištu.
8. ZABRANJENE AKTIVNOSTI
Na parkiralištu je zabranjeno:
- nepropisno parkiranje;
- blokiranje ulaza, izlaza ili prometnih površina;
- zauzimanje više parkirnih mjesta bez odobrenja;
- oštećivanje opreme ili infrastrukture;
- obavljanje neovlaštenih komercijalnih aktivnosti;
- pranje ili popravak vozila, osim ako je izričito dopušteno;
- odlaganje otpada;
- ostavljanje vozila na način kojim se ugrožava sigurnost drugih osoba ili vozila;
- svako drugo postupanje protivno pravilima parkirališta.
9. PRISTUP VOZILU I KONTROLA PARKIRANJA
9.1. PayParq odnosno ovlašteni operator može provoditi kontrolu korištenja parkirališta radi provjere poštivanja ovih Uvjeta.
9.2. Kontrola može uključivati provjeru registarske oznake vozila, vremena ulaska i izlaska, podataka o plaćanju te druge podatke potrebne za upravljanje parkiralištem i provedbu ovih Uvjeta.
10. NAPUŠTENO I NEPROPISNO PARKIRANO VOZILO
10.1. Ako je vozilo parkirano protivno ovim Uvjetima ili predstavlja smetnju sigurnosti i prometu, PayParq odnosno ovlašteni operator može poduzeti mjere dopuštene važećim propisima.
10.2. Troškovi uklanjanja vozila ili drugih mjera mogu se naplatiti Korisniku kada je to dopušteno zakonom.
11. AUTOMATSKO PREPOZNAVANJE REGISTARSKIH OZNAKA
11.1. Korisnik svojim ulaskom na parkiralište prihvaća da se za potrebe upravljanja i kontrole parkirališta mogu koristiti sustavi za automatsko ili mobilno prepoznavanje registarskih oznaka vozila (LPR/ANPR).
11.2. Sustav može evidentirati registarsku oznaku vozila, datum i vrijeme evidentiranja, lokaciju te druge podatke povezane s korištenjem parkirališta.
11.3. Podaci se mogu koristiti radi:
- kontrole plaćanja parkiranja;
- utvrđivanja neovlaštenog parkiranja;
- dokumentiranja povrede ovih Uvjeta;
- upravljanja parkiralištem;
- sprječavanja zlouporabe;
- naplate potraživanja;
- rješavanja prigovora i sporova;
- zaštite i ostvarivanja pravnih zahtjeva.
12. OSTALI UVJETI KORIŠTENJA
12.1. Na pojedinom parkiralištu mogu vrijediti dodatna pravila koja su istaknuta na ulazu, parkirnim mjestima, automatu, web stranici ili drugom odgovarajućem mjestu.
12.2. U slučaju neslaganja između općih i posebnih pravila primjenjuju se posebna pravila istaknuta za konkretno parkiralište, u mjeri dopuštenoj zakonom.
13. POSEBNO OVLAŠTENJE ZA DUGOTRAJNO PARKIRANJE
13.1. Dugotrajno ili posebno parkiranje može biti dopušteno samo uz prethodno odobrenje PayParqa odnosno operatora parkirališta.
13.2. Korisnik je dužan poštivati uvjete i rokove takvog odobrenja.
14. OSTALO
14.1. PayParq zadržava pravo izmjene ovih Uvjeta kada je to potrebno radi pravilnog upravljanja parkiralištem, promjene načina naplate ili usklađivanja s važećim propisima.
14.2. Za pitanja koja nisu uređena ovim Uvjetima primjenjuju se važeći propisi Republike Hrvatske.

Nadzor i upravljanje parkiralištem na temelju prepoznavanja registarskih oznaka
Obavijest o obradi osobnih podataka
1. Voditelj obrade: Indirektno, Obala Kneza Domagoja 52, 21322 Brela
2. Svrha obrade: Provedba ugovora o korištenju parkirališta, naplata parkiranja, te kontrola i zaštita parkirališta.
3. Pravna osnova: Nužnost obrade za izvršenje ugovora čija je stranka ispitanik (Korisnik) ili za poduzimanje radnji na zahtjev ispitanika prije sklapanja ugovora, te legitimni interes voditelja obrade za zaštitu imovine i naplatu potraživanja.
4. Primatelji podataka: Indirektno i ovlašteni izvršitelji obrade (pružatelji IT usluga, održavanje sustava i pravne usluge naplate).
5. Razdoblje pohrane: Podaci se čuvaju onoliko dugo koliko je potrebno za ispunjenje svrhe obrade, odnosno sukladno zakonskim propisima i rokovima zastare.
6. Prava ispitanika: Pravo na pristup osobnim podacima, ispravak, brisanje, ograničenje obrade, prigovor na obradu, te pravo na podnošenje pritužbe nadzornom tijelu (Agencija za zaštitu osobnih podataka - AZOP).
27. Demo Content, Example Data, Listing Photos & Prices
- Mock data. Screenshots, videos, demo accounts, the demo car park, sample reservations and other examples shown on payparq.com, in the PayParq apps and in our marketing materials use fictitious (mock) data, including names, e-mail addresses, phone numbers, licence plates, payments and reservation codes. Any resemblance to real persons, vehicles or transactions is coincidental.
- Example licence plates. Licence plates in demos, the demo account, test bookings, screenshots, videos and photos are invented or randomly generated and may by chance match a real registered vehicle. Such a match does not mean that the vehicle, its owner or its driver was at that location, used PayParq, or has any connection with PayParq or the content shown, and no conclusion about any real person or vehicle may be drawn from it. If an example plate matches your vehicle, write to payparq@outlook.com and we will replace it without undue delay.
- Real personal data only with consent. Where real personal data is shown (for example a testimonial, a name or a photo of a person), it is published only with the prior consent of the person concerned (Art. 6(1)(a) GDPR). Consent can be withdrawn at any time by writing to payparq@outlook.com, after which the content is removed without undue delay.
- Listing photos and information. Photos, names, addresses, descriptions and availability of car parks are provided by, or published with the permission of, the respective owner or operator, or come from public sources. Some images are representative and may not show the exact location. Licence plates and faces in photos are blurred or removed where they could identify a person.
- Prices are indicative. Prices shown in listings, examples and demos are indicative and may change with dates, duration, demand or the operator's pricing. The price and terms shown at checkout, before you pay, are binding for your booking.
- To report content you believe shows your personal data or property without permission, contact payparq@outlook.com.
